Agreement to These Terms By accessing or using AIMusicTest (the "Service"), you agree to these Terms of Service ("Terms"). The Service AIMusicTest is an online tool that analyzes an uploaded audio sample and returns an AI music detection result indicating whether the sample is **likely AI-generated**, **uncertain**, or **likely human-made**, together with vocal/instrumental AI signals and a segment timeline. Detection is performed by a third-party provider (Modulate, Inc.) under **written authorization** that permits us to operate a publicly available, consumer-facing detection service and to display results to end users. --- ## 3. No Accuracy Guarantee — Detection Is Probabilistic (Important) AI music detection is **probabilistic** and **may produce incorrect results**, including false positives and false negatives. You acknowledge and agree that results: - are provided **"as is"** and as a **signal only**, **not definitive proof** and **not evidence**; - are **not factual determinations, legal conclusions, professional advice, or a determination of authorship**; - are **not a copyright, infringement, or ownership determination**; - must **not** be relied upon as the sole basis for any legal, financial, business, employment, reputational, or other high-stakes decision about any person or work. We make **no representation of accuracy** and do not claim any specific detection rate. We do not identify the source or generation tool of a track. You are solely responsible for how you interpret and use any result. This disclaimer is displayed on the result page and applies throughout these Terms. --- ## 4. Eligibility and Accounts The Service uses **Sign in with Google**. A Google account is needed to purchase credits and to claim the login bonus. You must be at least **13** years old (**16** where required in the EU), and minors need guardian consent. You are responsible for activity under your account and for keeping your Google account secure. We may suspend or terminate accounts that breach these Terms or applicable law. --- ## 5. Free Scans and Full Scan Credits - **Free Scans:** up to **3 per calendar month** for guests (limited by IP address and a browser local identifier); **+2** additional free scans per month after signing in with Google (once per Google account per month). Free Scans analyze up to **30 seconds** and reset on the 1st of each month. - **Full Scan Credits:** purchased one-time packs (e.g., Starter: 20 scans for **$2.99**; Popular: 100 scans for **$5.99**). **1 credit = one 60-second Full Scan.** Credits **never expire** and are **not** reset monthly. Credits require Google sign-in and are bound to the Google account used at purchase. - Free Scans and Full Scan Credits are kept **separate**. Free Scans never consume credits. When you choose Full Scan, a credit is deducted; a Free Scan is not consumed first. We take reasonable, idempotent measures to avoid accidental or duplicate credit deduction. - Prices are shown in US dollars. **Taxes:** Prices are shown before any applicable taxes; applicable taxes are calculated at checkout based on your location. --- ## 6. Your Uploads and Warranties - You may upload **only** audio that you **own or are otherwise fully authorized to upload and submit for analysis**. You represent and warrant that you hold all rights, licenses, consents, and permissions necessary to upload the audio and to have it processed by the Service and its detection provider. - You must not upload illegal content, content that infringes copyright or any other third-party right, or content you are not permitted to share. - You must not upload audio containing another person's voice or personal data without the required consent. - We may refuse, restrict, or remove content that violates these Terms or applicable law, and may report violations to competent authorities. - **Copyright complaints:** see our DMCA Policy at **mailto:support@aimusictest.com?subject=DMCA%20Copyright%20Notice** or email **support@aimusictest.com**. --- ## 7. Audio Handling and Retention Uploaded audio is used only for the requested detection. We send only a trimmed **30s/60s sample** to our detection processor (Modulate, Inc.). **Our own copies are deleted within a maximum of 24 hours** (normally as soon as the scan completes or the credit is refunded). **Our detection processor may retain the submitted sample under its own policy, currently up to 35 days.** These two retention periods are separate. See our Privacy Policy for full details. --- ## 8. Credits, Payment, Refunds and EU Withdrawal Rights - Payments are processed by **PayPal**. We do not store full payment card details. - **Failed scans are refunded automatically:** where a scan fails to produce a valid result after a credit or free scan has been deducted — due to API failure, timeout, audio-cropping failure, worker/network failure, or another system error — the deduction is reversed automatically (a failed Free Scan restores the Free Scan; a failed Full Scan restores a Full Scan Credit). Pre-upload validation errors (unsupported format, file over 10 MB, audio under 12 seconds, unreadable/corrupt file) never deduct quota. Refunds and deductions are idempotent — no duplicate refunds or charges. - Save for the automatic refunds above and where required by law, all purchases are **final and non-refundable**. Credits remain usable; they are not redeemable for cash. - **EU/EEA consumers — right of withdrawal:** you normally have a **14-day right of withdrawal** for digital content/services (Directive 2011/83/EU). By purchasing and requesting immediate performance, you **expressly consent to the supply beginning immediately** and **acknowledge that you lose your right of withdrawal once performance has begun**. This consent and acknowledgement are captured at checkout where required. If you do not consent, do not purchase and request immediate performance. - If you believe you were charged in error, please contact us first at **support@aimusictest.com**; we will help resolve it before any dispute is escalated. --- ## 9. Acceptable Use You agree not to: - use the Service for any unlawful purpose or in violation of any third party's rights; - reverse engineer, scrape, overload, or circumvent the Service, its security, or its rate limits; - resell, sublicense, or provide access to the Service to third parties without our written consent; - use results to harass, defame, or make discriminatory or high-stakes decisions about any person; - misrepresent the Service as official, endorsed, certified, or guaranteed in any way, or use unverified accuracy claims. --- ## 10. AI Music Challenge The AI Music Challenge is an **entertainment and educational** feature. Its question bank uses only audio for which we hold the necessary rights or licenses, and we maintain an **internal per-track authorization ledger** recording the source, license, and evidence for each track. AI/human labels are provided for the game and are **not** a detection guarantee. Challenge tracks are used only with the necessary rights or licenses, documented in our internal authorization records. --- ## 11. Third-Party Services The Service relies on third parties, including **Cloudflare** (hosting/database/storage), **Google** (sign-in, and analytics if enabled), **PayPal** (payments), and our detection processor **Modulate, Inc.** Their availability and terms are outside our control. Detection may be interrupted, changed, degraded, or discontinued. We do **not** promise or guarantee any service level, uptime, or availability. --- ## 12. Intellectual Property The Service, its design, and its content (excluding your uploaded audio) are owned by us or our licensors and are protected by intellectual-property laws. You retain ownership of your uploaded audio, subject to the limited license necessary to provide the Service. Detection outputs are generated from our provider's results and, as between you and us, may not be copied, resold, or redistributed as a standalone product without our written consent. --- ## 13. Disclaimers and Limitation of Liability The Service is provided **"as is"** and **"as available"**, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, and our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) **$100**. Nothing in these Terms limits liability that cannot be limited by applicable law (for example, liability for gross negligence, wilful misconduct, or death/personal injury where such limitation is not permitted). Mandatory consumer-protection rights in your country of residence are not affected. --- ## 14. Indemnity You agree to indemnify, defend, and hold harmless AIMusicTest and its operator from and against claims, damages, liabilities, and costs (including reasonable legal fees) arising from: your uploaded audio; your use of the Service; or your breach of these Terms or violation of any third-party right. --- ## 15. Governing Law and Disputes These Terms are governed by **the laws of the State of California, United States**, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of **the state or federal courts located in California, United States**, unless mandatory consumer-protection law in your country of residence gives you the right to bring proceedings elsewhere. Nothing here waives any non-waivable consumer right. --- ## 16. Changes, Suspension and Termination We may modify, suspend, or discontinue the Service or these Terms at any time. Material changes to these Terms will be posted with a new "Last updated" date, and continued use after the effective date constitutes acceptance. You may stop using the Service at any time. --- ## 17. Sanctions and Export Controls You may not use the Service if you are located in, or a resident of, a jurisdiction subject to applicable trade sanctions, or if you are on a restricted-party list.
